Terms of Use

These Terms of Use ("Terms") are an agreement between you and Bazarla ("Bazarla", "we", "us"), which operates the online marketplace at bazarla.mu for buying and selling in Mauritius. By creating an account or using Bazarla, you agree to these Terms. If you do not agree, please do not use Bazarla.

Beta notice. Bazarla is currently in private beta. No real payments are processed on the platform, and no card or bank details are collected. The service is provided for testing and may change, be interrupted, or have its data reset at any time.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use Bazarla. You agree to provide accurate information and to keep it up to date.

2. Your account

You are responsible for your account and for keeping your password and any two-factor method secure. Keep one account per person, don't share it, and tell us promptly if you suspect unauthorised use. You're responsible for activity that happens under your account.

3. The marketplace — how it works

Bazarla is a venue that connects buyers and sellers. We are not a party to the sale itself, we don't take possession of items, and we don't guarantee any listing, buyer, or seller. The contract for an item is between the buyer and the seller.

4. Buying — bids and offers

  • Bids are commitments. Placing a bid in an auction is a binding offer to buy at that price. If you have the winning bid when the auction ends, you agree to buy the item.
  • Proxy bidding. You set the maximum you're willing to pay; we bid on your behalf in the minimum increments needed to keep you in front, only up to your maximum. Your maximum is not shown to others.
  • Best offers. On fixed-price listings you may send the seller an offer, which they can accept, decline, or counter. An accepted offer is a commitment to buy at the agreed price.
  • There is no buyer-protection programme or escrow during the beta. Arrange payment and collection directly with the seller, and use your judgement.

5. Selling

  • You must own the item or have the right to sell it, and describe it accurately.
  • Listing an auction or accepting an offer is a commitment to sell to the winning bidder or the accepted buyer at that price, and to hand over the item as described.
  • You are responsible for complying with all laws that apply to what you sell.

6. Fees

During the beta, Bazarla charges no fees and processes no money. Going forward, our intended model is a final value fee — a percentage of the sale price, charged to the seller only when an item sells — and optional paid features such as promoted listings. Any fees will be disclosed clearly before they apply.

7. Prohibited items and conduct

  • Don't list anything illegal, stolen, counterfeit, recalled, or otherwise restricted under Mauritian law.
  • Don't manipulate the marketplace — no shill or fake bidding, fee avoidance, price manipulation, or misuse of another person's account.
  • Don't harass other users, post unlawful content, or attempt to disrupt the service.

8. Payments and collection

Bazarla does not process payments or hold funds during the beta. Buyers and sellers settle payment and arrange collection or delivery directly between themselves. Bazarla is not responsible for those arrangements or their outcome.

9. Your content

You keep ownership of the listings, photos, messages, and other content you post. You grant Bazarla a non-exclusive, royalty-free licence to host, display, and distribute that content for the purpose of operating and promoting the marketplace. You confirm you have the rights to the content you upload.

10. Moderation, suspension and removal

We may review, edit the status of, or remove listings, and we may suspend or close accounts that breach these Terms or harm other users. An account you delete (or that an admin deletes) is retained for about 30 days so it can be recovered, then permanently removed.

11. Disclaimers and liability

Bazarla is provided "as is" and "as available", without warranties of any kind. We are not responsible for the acts of users, the quality, safety, or legality of items, or whether a buyer or seller will complete a transaction. To the extent permitted by law, Bazarla's liability to you is limited, and we are not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law.

12. Privacy

Our Privacy Policy explains what personal data we collect and how we use it, and forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we'll update the date above and, where appropriate, let you know. Continuing to use Bazarla after a change means you accept the updated Terms.
